How Are Legal Fees Calculated in Kenya & How Are Bank Securities Perfected? Client FAQ Guide
Job Mwanthi 2026-10-28 Banking, Corporate & Tax Law

Answering your questions on the Advocates Remuneration Order, bank charges & debentures, statutory legal audits, and booking a consultation.

Transparency in legal fees and clarity on statutory procedures are the foundation of client trust. At Job Mwanthi & Associates Advocates, we answer the most common questions from individual, SACCO, corporate, and banking clients regarding legal fees and security perfection in Kenya.

Q1: How are legal fees determined by Advocates in Kenya?

Legal fees in Kenya are regulated by statute under the Advocates Act (Cap 16) and the Advocates (Remuneration) Order. Depending on the instruction, fees are calculated either on an ad valorem scale (based on the value of the subject matter, such as the property purchase price, loan facility amount, or value of the claim in court) or on schedule fees for non-contentious corporate filings. We always provide a clear fee note and retainer agreement upfront.

Q2: What is involved in perfecting a Bank Charge or Corporate Debenture in Kenya?

When a borrower takes a secured facility from a commercial bank or SACCO, our Banking & Finance unit prepares and registers:

  • Legal Charges & Further Charges: Ensuring full compliance with Sections 79, 80, and 93 of the Land Act, 2012 (including independent legal advice and spousal/LCB consents).
  • Corporate Debentures & Form CR25: Registering company charges at the Business Registration Service (BRS) within the mandatory 30-day statutory window under the Companies Act, 2015.
  • Chattels & MPSR Filings: Perfecting security interests over motor vehicles, machinery, and receivables on the Movable Property Security Rights (MPSR) eCitizen collateral registry.

Q3: Where is Job Mwanthi & Associates Advocates located and how do I book an appointment?

Our firm (established in 2025) is headquartered at Kenco Building, Makindu (P.O Box 132 - 90138), with regional reach across Makueni, Machakos, Syokimau, Nairobi, Mombasa, and Malindi. You can book a consultation online via our Appointment portal or call us directly on 0769 880 815.
